Thank you for your interest in the Colorado Passport Program (the “Program”). These terms and conditions (the “Terms”) are an agreement between you and the State of Colorado (the “State”), acting by and through the Colorado Tourism Office (“CTO”), in relation to your participation in the Program. By participating in the Program, you accept and agree with these Terms. 1. Changes to the Terms. We reserve the right to change these Terms at any time without notice to you by posting changes on colorado.com/passport-terms You are responsible for regularly reviewing information posted online to obtain timely notice of such changes. You accept any amended Terms by continuing to participate in the Program after changes are posted. 2. Must be 18 Years of Age. You must be 18 years of age or older to participate in the Program. If you are a parent or guardian and believe your child is participating in the Program without your consent, please contact us at [email protected], and we will remove your child’s account. 3. Privacy. CTO works with third-party partners, Miles Partnership and Bandwango, to operate the Program. Any information you provide through the Program is treated in accordance with Bandwango’s Privacy Policy, available at https://www.bandwango.com/legal/privacy (the “Privacy Policy”). By participating in the Program, you consent to the use of your information in accordance with the Privacy Policy. 4. Program Details. a. Definitions. i. Voucher: Digital proof that entitles the holder to certain goods, services, or experiences offered by a Merchant. ii. Merchant: The business or entity identified on a Voucher that is responsible for providing goods, services, or experiences offered on a Voucher. b. Passports. i. The Program offers multiple varieties of Colorado Passports with different collections of curated attractions, retailers, and restaurants. ii. You may sign up for one or more Colorado Passports. c. Vouchers. i. Generally. Passports may include Vouchers for deals and discounts that are redeemable when you visit participating Merchants. When you visit a participating Merchant, show your phone to staff to redeem any available discounts or deals. ii. Passholder Support and Refund Policy. If you are not satisfied with a Voucher, contact Bandwango Passholder Support at the information below. Bandwango Passholder Support will address your concerns and do its best to resolve the issue. Voucher extensions will only be considered for unused passes or items still within the activation period. Extensions will not be granted beyond 365 days from the purchase date. Extension requests for events and specific time-sensitive admissions will not be honored. Refunds or exchanges for unredeemed vouchers are considered on a case-by-case basis. Refund requests for events, attractions, and specific admissions may not be honored. The Merchant is fully responsible for the quality and care of all goods and services it offers and for any injuries, illnesses, damages, claims, liabilities, or costs (“Liabilities”) you may incur directly or indirectly, whether related to the Voucher’s use or not. By accepting these terms, you waive and release CTO, Miles Partnership, and Bandwango, including their subsidiaries, affiliates, partners, officers, directors, employees, and agents (collectively, the “Released Parties”), from any Liabilities arising from, related to, or sustained in connection with any act or omission by the Merchant, its employees, agents, contractors, or invitees in connection with your use of a Voucher or the goods, services, or experiences provided. d. Check-Ins. i. Generally. You can use your mobile device to check-in at Merchants or attractions included in various Passports. To check in, enable your location on your mobile device and tap “Check-In” once you’re at a participating attraction. Once you’ve checked in successfully, a gray checkmark will appear on your device screen. ii. Sweepstakes. When you use your mobile device to check in at a participating attraction beginning on or around January 15, 2026, you will earn an entry to our Colorado Passport Sweepstakes. Please see the Sweepstakes Official Rules here for more details. 5. Disclaimers. i. General Disclaimer. YOUR PARTICIPATION IN THE PROGRAM IS AT YOUR OWN RISK. THE INFORMATION, MATERIALS, PRODUCTS AND SERVICES PROVIDED ON OR IN CONNECTION WITH THE PROGRAM ARE PROVIDED “AS IS”, “AS AVAILABLE,” AND WITHOUT ANY WARRANTIES OF ANY KIND. THE STATE HEREBY DISCLAIMS ALL WARRANTIES, REPRESENTATIONS AND ENDORSEMENTS, EXPRESS OR IMPLIED, WITH REGARD TO THE PROGRAM, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. ii. Accuracy. We make no representation or warranty as to the completeness, accuracy or currentness of information or content provided in the Program. Such information is also subject to change at any time without notice. 6. Governing Law, Jurisdiction and Venue. Your participation in the Program and these Terms are governed by the laws of the State of Colorado. By participating in the Program, you consent to the jurisdiction of the courts located in the City and County of Denver, Colorado for any action arising from these Terms. Any dispute concerning your participation in the Program shall be resolved in a court of appropriate jurisdiction in the City and County of Denver, Colorado. 7. Entire Agreement. These Terms constitute the entire agreement between you and the State, and supersede any and all prior terms, agreements, representations, or warranties concerning your participation in the Program. 8. Severability. Any invalid or unenforceable provision in these Terms shall be deemed severed from this agreement to the extent of its invalidity or unenforceability, but only to the extent necessary to resolve the invalidity or unenforceability, and the remainder of this agreement will remain in full force and effect. 9. No Waiver. The State’s failure to act with respect to any breach of these Terms does not constitute a waiver and shall not limit the State’s rights or remedies with respect to any such breach or subsequent breaches. 10. Governmental Immunity. Notwithstanding all other provisions in these Terms, liability for claims for injuries to persons or property arising from the negligence of the State, its departments, boards, commissions committees, bureaus, offices, employees and officials shall be controlled and limited by the provisions of the Colorado Governmental Immunity Act, § 24-10-101, et seq., C.R.S.; the Federal Tort Claims Act, 28 U.S.C. Pt. VI, Ch. 171 and 28 U.S.C. § 1346(b), and the State’s risk management statutes, §§ 24-30-1501, et seq. C.R.S. No term or condition of these Terms shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protections, or other provisions contained in these statutes. The Colorado Passport Sweepstakes (“Sweepstakes”) is sponsored by the State of Colorado, by and through the Colorado Tourism Office (“CTO” or “Sponsor”) and administered by Miles Partnership, LLLP (“Administrator”). The Sweepstakes is subject to these Official Rules. By participating in the Sweepstakes, each entrant agrees to be bound by these Official Rules and the decisions of the Sponsor and/or Administrator, which are final and binding in all respects. This Sweepstakes is governed by the laws of the State of Colorado, United States of America. VOID OUTSIDE THE UNITED STATES AND WHERE PROHIBITED BY LAW. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. The odds of winning depend on the total number of eligible entries received during the Sweepstakes Period. SWEEPSTAKES PERIOD: The Sweepstakes begins at 12:01 a.m. MT on January 15, 2026, and ends at 11:59 p.m. MT on December 31, 2026 (the “Sweepstakes Period”). ELIGIBILITY: The Sweepstakes is open only to individuals residing in the 50 United States and U.S. Territories, who at least 18 years old at the time of entry. For example, if an entrant wins a Passport Prize of $500 United Airlines MileagePlus TravelBank credit for the 64 County Challenge Passport, she is not eligible to win an additional Passport Prize for the 64 County Challenge Passport, nor is she eligible to win a Passport Prize for a different Passport variety. Grand Prize: The Grand Prize winner will be selected from all entries submitted during the Sweepstakes Period. Any entrant is eligible to win the Grand Prize, including entrants who won a Passport Prize. All expenses relating to acceptance of a prize, including but not limited to federal, state, or other tax liabilities, are the sole responsibility of the winner. TO ENTER: There are two (2) ways to enter the Sweepstakes: Passport Check-Ins: During the Sweepstakes Period, sign up for one or more Passport varieties from the Colorado Passport program. Use your mobile device to check in at participating attractions featured in the Passports. To check in, enable your location on your mobile device and tap “Check-In” once you’re at a participating attraction. Once you’ve checked in successfully, a gray checkmark will appear on your device screen. You may check in once at every Passport attraction. Each check-in counts as one entry for a Passport Prize for each Passport variety, and one entry for the Grand Prize. For example, checking in at an attraction included in the 64 County Challenge Passport counts as an entry to win a prize for that Passport variety. All check-ins are subject to verification by Sponsor or Administrator. Mail-In: To enter by mail, print your first and last name, e-mail address, street address (P.O. boxes not accepted), city, state, zip code, telephone number, indicate the Passport variety for which you are submitting an entry, and mail it to Miles Partnership LLLP, Attn. Colorado Passport Sweepstakes, 404 S. Upham Street, Lakewood, CO 80226. Mail-in entries must contain at least first and last name, telephone number or an email address to be valid. The number of mail-in entries per individual, per Passport is limited to the number of merchants or attractions featured in each Passport. Mail-in entries must be received by 5:00 p.m. the day each Passport Variety closes as listed above. Once submitted, all entries become the exclusive property of Sponsor and will not be acknowledged nor will they be returned. No facsimiles or electronic entries allowed. POTENTIAL WINNER NOTIFICATION: Sponsor or Administrator will notify the potential winners of the Grand Prize and Passport Prizes (“Potential Prize Winners”) promptly after the Sweepstakes Period using the contact information provided during entry. A Potential Prize Winner must respond to Sponsor or Administrator within fourteen (14) business days. The Potential Prize Winners shall be subject to eligibility verification and compliance with these Official Rules. If any required information is not returned by the requested due date or if any notification is returned as undeliverable, then the Grand Prize or Passport Prizes may be forfeited and an alternate Grand Prize Winner and/or Passport Prize Winner may be selected randomly from the remaining entries. Sponsor and Administrator will not be obligated to pursue more than one (1) alternate winner for each Prize. RELEASE: By accepting a prize, each winner agrees to release and hold harmless the Sponsor Parties from any and all liability, loss or damages arising from or in connection with the Sweepstakes or the awarding, receipt, and/or use or misuse of any prize or participation in any prize-related activities, including without limitation property damage or personal injury which may arise directly or indirectly from acceptance or use of any prize. GENERAL CONDITIONS: Entrants agree to be bound by these Official Rules and by the decisions of Sponsor and Administrator, which are final and binding in all respects. Sponsor reserves the right to change these Official Rules at any time, in its discretion, and to modify, suspend, or cancel the Sweepstakes, or any entrant’s participation in the Sweepstakes should viruses, bugs, unauthorized human intervention, public disruptions, or other causes beyond Sponsor’s reasonable control affect the administration, security, safety or proper play of the Sweepstakes, or Sponsor otherwise becomes (in its discretion) incapable of running the Sweepstakes as planned. Entrants who violate these Official Rules, violate any law, rule, or regulation in connection with participation in the Sweepstakes, tamper with the operation of the Sweepstakes or engage in any conduct that is detrimental or unfair to Sponsor or any other entrant (as determined in Sponsor’s discretion) are subject to disqualification from the Sweepstakes. In particular, Sponsor and/or Administrator reserve the right to refuse to award a prize to an entrant if, in Sponsor’s and/or Administrator’s sole discretion, Sponsor and/or Administrator suspect that an entrant engaged in any fraudulent activity, hacking, technical manipulation, or abuse of the program, including but not limited to (1) submitting false or inaccurate check-in information, (2) attempting to check-in remotely (not physically present at a Passport attraction), or (3) using automated methods to accrue check-ins. Any decision by Sponsor and/or Administrator to disqualify any entrant or withhold any prize is final and binding. ADDITIONAL TERMS: No prize substitution or transfer of prizes will be permitted, except by Sponsor or Administrator, in their sole discretion. Sponsor reserves the right to award a prize of equal or greater value in the event the stated prize is unavailable. By participating, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of Sponsor and/or Administrator, and warrants that he/she is eligible to participate. Sponsor reserves the right to terminate, suspend or amend the Sweepstakes, without notice, and for any reason, including, without limitation, if Sponsor determines that the Sweepstakes cannot be conducted as planned. In the event any tampering or unauthorized intervention may have occurred, Sponsor and/or Administrator reserve the right to void suspect entries at issue. Sponsor and/or Administrator reserve the right to disqualify anyone tampering with this Sweepstakes, including, but not limited to, anyone who violates these Official Rules in any respect. Sponsor and/or Administrator also reserve the right to review and/or disqualify any and all entries deemed by Sponsor or Administrator, in their sole discretion, to be inappropriate, offensive, or otherwise unacceptable. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Any provision of these Official Rules deemed unenforceable will be enforced to the extent permissible, and the remainder of these Official Rules will remain in effect. The use of the terms “include” or “including” in these Official Rules is illustrative and not limiting. PRIVACY; USE OF SUBMITTED MATERIALS. Any information collected from the Sweepstakes shall be used only in a manner consistent with the consent given by the entrant at the time of entry, with these Official Rules and with Sponsor’s privacy statement available at: https://www.colorado.com/privacy-policy. Sponsor may engage certain third-party companies to perform services in connection with the administration of this Sweepstakes and information provided by entrants may be collected and used by those third parties for purposes of administration of the Sweepstakes and the fulfillment and verification of prize awards. In the event of any conflict between the Sponsor’s privacy statement and these Official Rules, these Official Rules shall govern.
